Official Important Notice: Force Majeure Declaration and Suspension of 99FX Services in the Middle East

Due to exceptional and rapidly escalating events in the region, 99FX formally announces the suspension of operations and services for its Middle East clients, effective March 1, 2026, as a direct result of Force Majeure circumstances entirely beyond the company’s operational and human control.

1) Event and Geopolitical Context

The regional digital infrastructure suffered major disruption, including outages at Amazon Web Services (AWS) data centers in Bahrain region (me-south-1), driven by military escalation and armed conflict affecting critical facilities and energy supply chains.

• Total access loss: our technical teams lost access to servers, systems, and databases tied to Middle East operations.
• Ongoing outage: as of this notice, Amazon has not restored Bahrain-zone operations or provided immediate technical recovery options.

2) Legal Position (Force Majeure Clause)

Based on 99FX Privacy Policy and Terms of Use, Force Majeure provisions apply:

“The company is exempt from liability for any delay or failure to perform obligations if caused by events beyond reasonable control, including but not limited to war, hostilities, explosions, disruption of public/private communications networks, or collapse of global cloud infrastructure providers.”

Therefore, the Bahrain AWS infrastructure incident is legally classified as an unforeseeable and unavoidable event, creating operational impossibility and releasing the company from legal and financial liability for resulting service interruption damages.

3) Losses and Current Actions

99FX has incurred significant losses estimated in the millions due to system outages, critical operational data loss, and interruption of business flow.

• Technical responsibility: hardware/server recovery remains under Amazon Web Services responsibility.
• Lack of compensation: in war-related incidents, insurers and hosting providers typically reject immediate compensation.
• Ongoing work: our administrative and technical teams are evaluating alternatives for potential data migration to more stable cloud regions.

Conclusion

99FX deeply regrets this disruption. However, Force Majeure governs the current situation. We will provide updates immediately upon receiving official reports from the Bahrain service provider.
