Funding Terms and Conditions – 99FX Company
Preliminary Note: By accepting the funding program, you agree to all the terms below and acknowledge that you are fully bound by them.
1. Definitions
- "The Company": 99FX Company.
- "The Trader" or "Client": The person who subscribes to the funding program.
- "Funded Capital": The amount allocated for trading (e.g., $100,000).
- "Funding Account": The account on which the trader conducts transactions according to the company's terms.
- "Profits": Any profit resulting from trading in the funded account after deducting fees and conditions.
- "Maximum Daily/Maximum Total Losses": The limits that, if exceeded by the trader, constitute a violation of funding terms.
- "Final Decision": The company's decision that cannot be reversed regarding accounts.
2. Eligibility Requirements
- The trader must be 18 years old or older.
- The use of copy trading programs or automated trading (using algorithmic software or robots) is prohibited unless explicitly permitted in separate documents.
- The trader is not allowed to use multiple simultaneous funding accounts under different names.
- If it is proven that the trader has provided false or misleading information, the company reserves the right to immediate cancellation.
3. Trader Obligations
- Commitment to a clear trading plan approved by the relevant department in the company (such as daily risk limits, total loss, prohibited strategies).
- Use stop loss for every trade unless explicitly exempted.
- Commitment not to enter randomly or use Martingale or Grid strategies unless approved verbally or in writing.
- Commitment not to exploit system errors or Latency Arbitrage or trade on very narrow time frames without justification.
- When there is any malfunction in the platform or data feed, the company must be informed immediately.
- It is not permitted to take open positions to other accounts or platforms or synchronize the account with external platforms without permission.
4. Risk Limits and Termination
- Maximum daily loss: If your loss on a given day exceeds the agreed percentage (e.g., 5%), the company has the right to terminate the account immediately.
- Maximum total loss: If your total loss exceeds the agreed percentage (e.g., 10%), accounts are closed permanently without any warning.
- The company reserves the right to terminate the account at any time without prior notice if it sees that the risks are excessive or the trading behavior does not align with the agreed standards.
- The termination decision from the company is final; the trader has no right to claim, object, or continue.
- Upon termination, all open trades are closed immediately, and remaining liquidity is calculated according to performance up to the moment of closure (if there is qualifying profit).
5. Profit Distribution and Withdrawal Request
- The trader has the right to request profit withdrawal only if they have fulfilled the agreed minimum trading period (14 trading days or according to policy).
- No profits are given or transferred if the account is in loss or violates trading terms or has been closed due to violation of terms.
- Withdrawals are processed within a time period determined by the company (e.g., 1-3 business days).
- The company reserves the right to impose processing fees if the amount exceeds transfer fees or if withdrawal requirements are not available.
- The minimum withdrawal must be reasonable (5% or equivalent) to cover bank transfer costs or international fees.
6. Terms and Policy Amendments
- The company reserves the right to modify or update the terms at any time, without the need for prior notice, at its absolute discretion.
- Your continued use of the funding account after the update means your automatic agreement to the new terms.
- It is the trader's responsibility to review the terms regularly.
7. Disclaimer and Company Limitations
- The company is not a financial broker and does not provide investment advice, and any trading activity you engage in is at the trader's sole responsibility.
- The company does not bear any losses outside the scope of account funding or any indirect or consequential damages.
- Past performance is not considered a guarantee of future performance, and risk warnings are clear.
- If the company is prevented from performing its obligations due to laws or governmental or legal decisions, it cannot be held responsible for that.
8. Information Confidentiality and Property Rights
- The trader maintains the confidentiality of all information received from the company and does not disclose it to any third party.
- All rights to the platform, software, and market data belong to the company, and disassembly, copying, reproduction, modification, or distribution is not permitted.
- The trader has no right to transfer the account or their rights to another person without written approval from the company.
9. Disputes and Applicable Law
- Any dispute arising between the trader and the company is resolved first through amicable means, then through arbitration or before a selected court at the company's location (or the agreed location).
- The law governing the contract must be specified (e.g., local law or the law of the company's country).
- If the court rules any clause invalid, the rest of the contract remains valid without affecting its validity.
Terms Amendment
We reserve the right to modify these terms and conditions at any time. You will be notified of any material changes 30 days before they take effect.
Your continued use of our services after amendments means you agree to the new terms. If you do not agree to the amendments, you may terminate your account.
